Terms of Service

These Terms of Service (“Terms”) govern your use of HiringTest.ai and HiringCase.com, operated by Sidekick Software Inc. (“we”, “us”, “our”), a Delaware corporation. By accessing or using our platform, you agree to these Terms. If you are accepting these Terms on behalf of a company, you represent that you have authority to bind that company.

1. Service description

HiringTest.ai provides AI-powered assessments for evaluating candidates' ability to work with AI tools in realistic professional contexts. Assessments come in multiple lengths (quick filter, standard screen, deep dive, and extended showcase) and combine scenario questions, an AI sandbox task, and optional Character-fit signals. Candidates receive a scored profile (the “scorecard”), and recruiters may share, compare, and disposition candidates through the platform.

HiringCase.com is the candidate-facing surface of the same platform — it lets candidates maintain a living résumé, collect endorsements from former colleagues, and publish a shareable case page. The two surfaces share one underlying account and data model.

We also offer optional integrations with applicant-tracking systems (Greenhouse, Ashby, Lever, Gem, Getro, Merge), an optional identity-verification step, and an outbound webhook API for syncing platform events into other tools.

2. Accounts and authentication

Access requires authentication via LinkedIn or Google OAuth. We do not support email + password authentication. You are responsible for the security of your authentication account with LinkedIn or Google, including its multi-factor settings.

You must be 18 or older to create an account. You agree to provide accurate registration information and to keep it current.

3. Recruiter responsibilities

Recruiters agree to use assessment results as one input in their hiring process, alongside interviews, reference checks, and other established methods. Assessment results are decision support, not the sole basis for any hiring decision.

You agree to share assessment links only with candidates who have applied to a role or have otherwise consented to take an assessment. You must not use the platform to bulk-test individuals without a bona-fide hiring purpose, and you must not redistribute, resell, or publicly share individual candidate scorecards without that candidate's consent.

You agree to use the platform consistent with applicable employment-law requirements, including but not limited to Title VII of the U.S. Civil Rights Act, the Americans with Disabilities Act, the EEOC's Uniform Guidelines on Employee Selection Procedures, and analogous laws in any jurisdiction you operate in. Accommodation requests from candidates are surfaced through the platform; you agree to honour them.

If you enable ATS write-back, you authorize us to write notes, stage changes, tags, and (for Greenhouse) candidate records into your connected ATS on your behalf, scoped to the permissions your ATS account already grants you. You remain responsible for the accuracy + appropriateness of any data written to your ATS through HiringTest.ai.

4. Candidate responsibilities

Candidates agree that the responses they submit are their own work. You may use general-purpose AI tools or reference material outside the assessment to the extent you would in your day-to-day work — that authenticity is itself signal — but you must not have another person take the assessment in your place, impersonate someone else, or otherwise misrepresent your identity. The platform's integrity signals (browser fingerprint, identity verification when enabled, response-pattern analysis) exist to detect this.

The AI sandbox provided as part of the assessment is the deliberate environment for measuring how you work with AI; you are encouraged to use it as you would a real tool.

6. AI-generated content

Scoring, interview-prep suggestions, presentation synthesis, tools-demonstrated analysis, and other AI-produced outputs are generated by foundation models accessed through Microsoft Azure AI Foundry. These outputs are probabilistic and should be treated as decision-support tools, not definitive judgments. We do not guarantee the accuracy, completeness, or fairness of any individual AI-generated output, though we continuously monitor for bias and calibration drift.

Your data is processed within Azure's enterprise infrastructure under data-processing terms that prohibit model training on customer data. See our Privacy Policy for the full subprocessor list and Trust & Security for retention and zero-day-retention specifics.

7. Data and intellectual property

Candidate assessment responses, uploaded files, and HiringCase résumé content remain the intellectual property of the candidate who created them. Recruiters receive a limited license to view + use scored results for hiring decisions made by their company.

The platform itself — the software, design, content, assessment templates, rubrics, and aggregated insights — is owned by Sidekick Software Inc. We retain the right to use fully-anonymized, aggregated data for model calibration, benchmarks, and product improvement, in a manner that does not identify any individual or company.

8. Payment, billing, and refunds

Role activation and assessment-link generation are free. Payment is required to unlock the full scorecard for a given role. Pricing is shown before any charge, and recruiters may unlock roles at the moment of viewing (pay- later) or upfront (pay-now, for a discount). Bulk packs and referral codes are available where applicable, and recurring purchase via autopay is an opt-in.

Payments are processed by Stripe. We do not store card numbers; we retain only payment-method metadata (brand, last-four digits, expiration). Recruiters may manage saved payment methods from their account settings.

Refunds are available within 14 days of an unlock if no additional scorecards have been viewed against that role. Bulk packs are refundable on a pro-rata basis for unused credits within 30 days of purchase. Refund requests go to billing@hiringtest.ai.

9. Service availability

We target 99.9% uptime on enterprise plans. We do not guarantee uninterrupted availability, and we may take the platform offline for planned maintenance with reasonable notice. The status page at status.hiringtest.ai reflects current operational state.

10. Termination

You may terminate your account at any time from account settings, or by emailing support@hiringtest.ai. We may terminate or suspend accounts that violate these Terms, that pose a risk to platform integrity, or that remain inactive for an extended period after exhausting paid credits. Upon termination, your data is deleted per the retention schedule in our Privacy Policy, except where we are required to retain it for legal reasons.

11. Disclaimers and limitation of liability

The platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that assessment results will be free from error or bias, that the platform will be uninterrupted, or that any specific hiring outcome will result from using it.

To the maximum extent permitted by law, Sidekick Software Inc. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform, including hiring decisions made based on assessment results. Our aggregate liability for any claim arising out of or relating to these Terms is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless Sidekick Software Inc. and its affiliates, officers, employees, and agents from any claim, damage, or expense (including reasonable attorneys' fees) arising from: (a) your use of the platform in violation of these Terms; (b) your violation of any law or third-party right; or (c) hiring decisions made by you based on platform output.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the platform will be resolved through binding arbitration administered by JAMS in San Francisco, California, except that either party may bring an individual action in small- claims court. You and we each waive any right to a jury trial or class action.

14. Open-source acknowledgments

The platform uses open-source software under permissive licenses (MIT, Apache 2.0, ISC). A current acknowledgments list is available on request to legal@hiringtest.ai.

15. Modifications

We may update these Terms as the platform evolves. Material changes will be communicated by email at least 30 days before they take effect for existing recruiter customers. Continued use of the platform after the effective date constitutes acceptance.
